Terms of Service

Last updated: [DATE]

1. Agreement to These Terms

These Terms of Service (“Terms”) are a legal agreement between you and Wylie Driving School (“we,” “us,” or “our”) governing your use of wyliedrivingschool.com and our online courses (together, the “Services”).

By creating an account, purchasing a course, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility and Accounts

  • You must be at least [MINIMUM AGE] years old to create an account. Students under 18 must have a parent or guardian create the account or provide consent.
  • You must provide accurate, complete information when registering. Course completion records are official documents, and false information may void your certificate.
  • You are responsible for keeping your password confidential and for all activity under your account.
  • One account per person. Accounts are personal and may not be shared, sold, or transferred.
  • Notify us immediately at [support@wyliedrivingschool.com] if you suspect unauthorized use of your account.

3. Course Enrollment and Access

  • Enrollment gives you a personal, non-transferable licence to access the course you purchased.
  • Course access lasts [X] days/months from the date of purchase unless stated otherwise on the course page.
  • You must complete the course yourself. Having another person take any part of the course on your behalf is grounds for immediate termination without refund.
  • Some courses have minimum time requirements set by law. You cannot skip ahead or complete a course faster than the required time.
  • We may require identity verification at any point during a course.

4. Certificates and Regulatory Requirements

[EDIT THIS SECTION TO MATCH YOUR ACTUAL APPROVALS. Do not claim an approval you do not hold.]

  • Certificates are issued only after you complete all course requirements, including any final examination.
  • We issue certificates in the form and within the timeframe required by [AGENCY NAME].
  • We are not responsible for how a court, agency, or insurer treats your certificate. Acceptance is at their discretion.
  • It is your responsibility to confirm that a course meets your specific requirement before purchasing. Check with your court, DMV, or insurer first.
  • We may be required to report your completion to a government agency. See our Privacy Policy.

5. Pricing and Payment

  • All prices are listed in [CURRENCY] and are subject to change. The price shown at checkout is the price you pay.
  • Payment is due in full at the time of purchase.
  • Government, court, or agency fees are separate from our course fee and are not included unless we state so explicitly.
  • Promotional prices apply only during the stated period and cannot be applied retroactively.
  • We use a third-party payment processor. We do not store your full card details.

6. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

7. Acceptable Use

You agree not to:

  • Record, copy, download, republish, or resell any course content
  • Share your login credentials or allow anyone else to use your account
  • Have another person complete any portion of a course for you
  • Use bots, scripts, or automated tools to progress through a course
  • Attempt to bypass timers, quizzes, or identity checks
  • Reverse engineer, scrape, or interfere with the Services
  • Upload malicious code or attempt to gain unauthorized access
  • Harass our staff or other students
  • Use the Services for any unlawful purpose

Violating this section may result in immediate suspension or termination without refund, and we may report the violation to the relevant regulator.

8. Intellectual Property

  • All course content, text, video, audio, graphics, logos, and software are owned by Wylie Driving School or our licensors and are protected by copyright and trademark law.
  • You receive a limited licence to access the content for personal educational use only.
  • You may not reproduce, distribute, modify, or create derivative works without our written permission.
  • Our name and logo are our trademarks. You may not use them without written permission.

9. Reviews and User Content

If you submit a review, comment, or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and reproduce it in connection with the Services. You confirm that the content is your own and does not infringe anyone’s rights. We may remove content at our discretion.

10. Third-Party Services and Links

The Services may link to third-party websites or use third-party tools. We do not control them and are not responsible for their content, terms, or privacy practices.

11. Availability

We aim to keep the Services available at all times but do not guarantee uninterrupted access. We may suspend access for maintenance, updates, or reasons beyond our control. We are not liable for losses arising from downtime.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be error-free, that a certificate will be accepted by any particular court, agency, or insurer, or that you will pass any test.

13. Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the Services is limited to the amount you paid us in the [X] months before the claim arose.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost opportunities, fines, penalties, or licence suspension.

Some jurisdictions do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Wylie Driving School, its officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

15. Termination

  • You may close your account at any time by contacting us.
  • We may suspend or terminate your account immediately if you breach these Terms.
  • On termination, your licence to access course content ends immediately.
  • Sections that by their nature should survive termination will survive, including Sections 8, 12, 13, 14, and 17.

16. Changes to These Terms

We may update these Terms. The revision date at the top will change. Material changes will be notified by email or a prominent site notice at least [X] days before they take effect. Continuing to use the Services after that date means you accept the revised Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of [STATE], without regard to conflict of law rules. Any dispute will be resolved in the courts of [COUNTY, STATE].

[If you intend to require arbitration or waive class actions, an attorney must draft that clause. Enforceability varies by state and a badly worded clause is void.]

18. General

  • If any provision is found unenforceable, the rest remains in effect.
  • Our failure to enforce a provision is not a waiver of it.
  • These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between us.
  • You may not assign these Terms. We may assign them in connection with a merger or sale.
